Please take a few minutes to read this document. It explains, in plain language, exactly what happens with your money, your dates, and your itinerary at every stage of your trip — from the moment you reserve to the moment you come home. We wrote it this way on purpose: a boutique travel experience deserves a policy you can actually understand, not one you have to hire a lawyer to decode.
Peru Wayna Picchu designs exclusive, tailor-made travel experiences across Peru. As local experts, we combine authenticity, meticulous planning, and close relationships with the best hotels, guides, trains, and boat operators in the country. Because many of the services in your itinerary — flights, the Inca Trail, Machu Picchu, river cruises — are sold to us by third parties under their own strict and often non-negotiable rules, this document explains clearly which parts of your trip are flexible and which are not, before you book, so there are never surprises later.
By confirming a reservation — online, by email, WhatsApp, or through your travel advisor — you ("the Client") accept these Terms & Conditions ("the Terms") in full, on behalf of yourself and everyone traveling in your party. If you book for other travelers, you confirm you have their authorization to accept these Terms for them.
Peru Wayna Picchu EIRL is a Peruvian company registered under Tax ID (RUC) 20601565243, specializing in the design of custom, premium itineraries throughout Peru.
We act as the designer and coordinator of your trip and as an intermediary between you and independent third-party providers — hotels, airlines, the Peruvian rail companies, cruise operators, transport companies, restaurants, and local guides. Each of these providers operates under its own terms, schedules, and policies, which we do not control. Our responsibility is to select trustworthy partners, coordinate every detail on your behalf, and represent your interests if something goes wrong — but we cannot override a provider's own rules (for example, an airline's fare rules or the Peruvian government's Inca Trail permit system).
A booking becomes confirmed and binding on the date we receive your deposit. From that moment, a contract exists between you and Peru Wayna Picchu EIRL, and we begin securing services on your behalf with our providers.
The person who makes the booking and pays the deposit confirms, on behalf of everyone in the party, that all travelers are aware of and accept these Terms.
Quotations are valid for a limited time (indicated on your proposal) because hotel, train, and cruise rates and availability change constantly. An unconfirmed quote is never a guarantee of price or availability.
For groups of 10 or more travelers, or for custom group quotes, specific deposit, payment, cancellation, and postponement terms may apply and will be stated in writing in your group proposal, taking precedence over the general terms below.
To confirm your reservation we require a deposit of 30% of the total program cost, with a minimum of USD 199. The deposit is non-refundable under any circumstance, as it is used immediately to lock in hotels, guides, and transport on your behalf.
The remaining balance must be paid in full no later than 30 days before your trip start date. If your booking is made within 30 days of departure, the full program cost is due immediately at confirmation. This 30-day mark is important: it is also the point after which our cancellation and postponement policies (Sections 7 and 8) become stricter, because by then we have already paid our providers in full on your behalf.
Non-payment of the balance by its due date will be treated as a cancellation by the Client, subject to the cancellation fees in Section 7.
Domestic and international flights booked through us must be paid 100% at the time of booking, regardless of your departure date, in order to secure the fare (see Section 11).
Bank / wire transfer to our official company accounts.
Credit card (Visa, MasterCard, and other major providers).
Zelle (for clients in the United States) or certified check / money order, where available.
Any fees charged by banks or card processors for international transfers or currency conversion are the responsibility of the Client and are not absorbed by Peru Wayna Picchu.
All prices are quoted and payable in United States Dollars (USD). If a price is shown in Euros, Pounds, or another currency for your convenience, it is a reference only. If, on the day of payment, that currency has moved more than 4% against the original USD-based quote, the amount due will be recalculated at the exchange rate in effect on the payment date.
Program prices do not include Peru's General Sales Tax (IGV) of 18%.
Peruvian citizens or residents requesting a Peruvian invoice will have 18% IGV added to the total.
Non-resident foreign travelers are exempt from IGV upon presentation of a valid passport and migratory card (TAM); travelers who have remained in Peru longer than 60 calendar days lose this exemption.
Our negotiated rates, supplier agreements, and commission structures are confidential. Invoices are issued for the total package price only; we do not provide supplier-level cost breakdowns or additional government documentation beyond the invoice and payment receipt. Purchasing our services constitutes acceptance of this policy.
Once your itinerary is confirmed, any change requested by you (dates, hotels, activities, number of travelers, etc.) will incur a USD 35 amendment fee, plus any additional cost charged by our suppliers as a result of the change. We will always do our best to accommodate changes, but availability can never be guaranteed, especially for the Inca Trail, Machu Picchu tickets, trains, and cruises, which are limited and sell out months in advance.
If a member of your party is unable to travel, we can usually transfer their booking to another person, provided we receive written notice at least 30 days before departure. A USD 50 administration fee applies, plus any costs charged by our suppliers to make the substitution (airlines, the Inca Trail permit system, and some train and cruise operators do not allow name changes at all — we will confirm case by case).
We want this to be impossible to miss. The services below are sold to us by third parties — including the Peruvian government, in the case of Machu Picchu and the Inca Trail — under rules that no travel agency, including ours, can change, refund, reschedule, or appeal. This applies to every cancellation and every postponement request, at any notice period, with no exceptions:

Because of this, we strongly encourage you to purchase comprehensive travel insurance that includes trip cancellation coverage (Section 15). It is the only way to recover these costs if your plans change unexpectedly.
All cancellations must be submitted in writing (email is sufficient) by the person who made the booking. The cancellation date is the date we receive your written notice, not the date you decide to cancel.

This schedule is directly tied to our payment terms: your balance is due in full at day 30 (Section 3), which is when we in turn pay our own suppliers on your behalf — so our ability to recover funds decreases sharply from that point on.
Refunds, when applicable, are processed within 30 business days of written confirmation, minus any bank or card-processing fees.
If one traveler cancels from a shared booking, the remaining travelers may be charged additional fees (e.g., single-room supplement, under-occupancy charges, loss of group pricing).
Groups of 10+ travelers and custom/negotiated bookings may carry different cancellation deadlines and fees, as specified in writing in your group proposal.
We understand plans change. If you need to move your trip to new dates rather than cancel it, the following applies:
With written notice 30 days or more before your original arrival date, we will convert the value of your refundable services into a travel credit, valid for 12 months from the date of your postponement request. You do not need to have new dates chosen right away — you can decide later, as long as travel is completed within that 12-month window.
Postponement requests made with less than 30 days' notice are treated under the Cancellation Policy in Section 7, not as a postponement, because by that point your balance has already been paid in full to our suppliers on your behalf.
The non-cancellable, non-postponable services listed in Section 6 (Inca Trail permits, Machu Picchu tickets, flights, Amazon cruises, select trains) cannot be moved to new dates under this policy either. If your itinerary includes any of these, ask your travel advisor for the specific rules and any applicable rebooking cost before you request a postponement.
New dates are subject to availability at the time of rebooking.
Rate differences due to seasonality, inflation, or supplier price changes between your original and new travel dates will apply. Peru Wayna Picchu does not absorb price increases between calendar years or booking periods; a neutral online inflation calculator can be used as a reference for expected variation.
This postponement policy applies to your first request. A second postponement of the same booking will be treated as a new cancellation and rebooking under Section 7.
We always aim to deliver every itinerary exactly as confirmed. Occasionally, however, local conditions require us to adjust a service in your best interest — for safety, quality, or continuity.
Adjustments that do not materially change your overall experience — a shifted activity time, a comparable or better hotel, a small logistical adjustment — may be made without prior notice and do not entitle you to a refund or compensation.
A major change is one that affects at least one in three full days of your itinerary, or materially changes the character of your trip as a whole. If a major change is necessary, we will notify you as soon as possible and, unless it results from force majeure, you may choose to:
Accept the revised itinerary; or
Accept an alternative program of comparable value, subject to availability; or
Cancel and receive a full refund for the services not yet rendered.
Force majeure means events beyond our reasonable control, including but not limited to: war or threat of war, civil unrest, strikes, terrorism, natural or nuclear disaster, fire, extreme weather, epidemics or pandemics, technical or mechanical failures in transport, and airline-imposed flight cancellations or schedule changes. In these cases, we are not liable for the resulting changes, delays, or costs, though we will always do everything possible to find comparable alternatives for you.
If costs from our suppliers increase after your booking is confirmed, Peru Wayna Picchu absorbs any increase of up to 2% of your total program price at no cost to you. If the increase exceeds 2%, we will notify you and charge only the difference above that threshold.
Deposits secure your booking; they do not lock the fare. A fare is only guaranteed once the ticket is paid 100% and issued.
Flight tickets are non-transferable. Changes or cancellations are governed exclusively by the airline's own rules and may carry significant penalties, up to full loss of value.
It is your responsibility to check every name, date, and time on your ticket as soon as you receive it and report any discrepancy immediately.
Peru Wayna Picchu is not liable for airline delays, cancellations, schedule changes, overbooking, mechanical issues, strikes, or weather — these are the airline's sole responsibility, and international carriage is further governed by international aviation conventions limiting airline liability.
We will assist you with any disruption, but rebooking fees and related costs are the Client's responsibility.
River cruises operate under the specific terms, deposit schedule, and cancellation policy of the cruise operator, which are typically stricter than our general policy and are non-refundable per Section 6. Cruises may also change their itinerary due to river levels, weather, or environmental and regulatory conditions in protected areas — this is outside our control and outside the operator's control.
You will receive detailed information on embarkation and disembarkation points as part of your confirmed itinerary. Please review these carefully and confirm they align with your other travel plans (flights, transfers); report any discrepancy immediately so we can correct it before departure.
You are solely responsible for holding a valid passport (with at least 6 months' validity beyond your travel dates, as commonly required), any necessary visas, and any other documentation required by Peruvian authorities or any other country on your itinerary. We recommend confirming requirements directly with the relevant embassy or consulate before booking flights. Peru Wayna Picchu is not responsible for denied boarding, denied entry, or missed services resulting from incomplete or invalid documentation.
Some destinations on our itineraries — particularly the Amazon and high-altitude areas such as Cusco and the Sacred Valley (up to ~3,400 m / 11,150 ft, and higher on some Inca Trail routes) — involve specific environmental and health considerations.
We recommend consulting a travel medicine specialist regarding yellow fever vaccination and tropical disease prevention if your itinerary includes the Amazon.
If you have any pre-existing condition, we recommend consulting your physician about altitude before traveling to Cusco or the Sacred Valley.
You must disclose any medical condition, illness, or disability that could affect your participation at the time of booking. Failure to disclose may result in exclusion from certain activities or from the trip, without a refund, if the undisclosed condition compromises your safety or that of the group.
If your itinerary includes any activity on or near water, please tell us at booking time if you are not a confident swimmer, so we can take appropriate precautions — this will not prevent you from participating.
Given the nature of international, multi-supplier travel, we strongly recommend purchasing comprehensive travel insurance before your trip, ideally including:
Trip cancellation and interruption coverage (ideally “cancel for any reason”, which covers services this policy does not, such as the Inca Trail and Machu Picchu tickets).
Emergency medical coverage and emergency evacuation.
Baggage loss or delay.
Peru Wayna Picchu assumes no responsibility for any cost arising from a Client's decision not to purchase adequate insurance.
Unaccompanied minors (under 18) cannot be accepted on our tours. Minors must travel with a parent or legal guardian who accepts full responsibility for them. Depending on the destination and the minor's travel documents, additional requirements may apply, including individual passports/IDs and notarized parental travel authorization where either parent is not traveling, or where required by Peruvian immigration law. Ensuring compliance with these requirements is the Client's responsibility.
Please honestly assess your physical fitness against the demands of your chosen itinerary before booking — some excursions (the Inca Trail, high-altitude hikes, certain jungle activities) require a moderate to high fitness level. Peru Wayna Picchu reserves the right to decline a booking, or to exclude a traveler from all or part of a tour, if in the reasonable judgment of our staff or guides a traveler's health or conduct could endanger the safety or wellbeing of the traveler or the group. In such cases, any resulting costs may be recovered from the Client.
Hotel star ratings (3, 4, 5 stars) reflect local and regional standards, which can vary from ratings you may be used to in North America or Europe. We select every property personally and will always describe honestly what to expect.
Part of what makes Peru extraordinary is also part of what makes it different from traveling at home. We ask every Client to keep this in mind and to travel with flexibility:
Transfer times can vary due to geography, altitude, and traffic, especially around Cusco and in the Sacred Valley.
Infrastructure and service rhythms differ from North America or Europe, particularly in rural and jungle areas.
Weather at altitude and in the Amazon can change quickly and affect visibility, trails, or river navigation.
These are genuine characteristics of travel in Peru, not service failures, and are not grounds for a refund or compensation under this policy. We will always keep you informed and help you adapt in real time.
All travelers must comply with the laws, regulations, and customs of Peru and any other country visited. Failure to do so releases Peru Wayna Picchu from any resulting obligation under these Terms, including if it results in denied access to a service, site, or destination.
If something is not right during your trip, please tell your guide or your Peru Wayna Picchu contact immediately — real-time notice is what lets us actually fix it or arrange fair compensation on the spot. If the issue remains unresolved, please put your complaint in writing to us within 28 days of the end of your trip; complaints submitted after this window may be more difficult for us to investigate and resolve with our suppliers.
During your trip, our guides or team may take photos or video of activities, landscapes, and group moments for use in our marketing (website, social media, brochures). By booking with us, you grant permission for your likeness to be used this way. If you prefer not to appear in any promotional material, simply let us know in writing before your trip begins and we will exclude you.
Peru Wayna Picchu is responsible for ensuring that the trip you book is delivered as described in your final confirmed itinerary and that services meet a reasonable standard. We act as an intermediary between you and independent service providers (hotels, airlines, train and cruise operators, transport and activity companies).
We are not liable for injury, illness, loss, damage, delay, or other issues caused by the acts, omissions, or negligence of independent third-party providers; such issues should be addressed with the provider directly, with our support in mediating.
We are not liable for disruptions caused by events outside our control, including those listed under Force Majeure (Section 9).
Our liability, where it applies, is strictly limited to the value of the services paid for and does not extend to indirect, incidental, or consequential damages, including subjective dissatisfaction or unmet personal expectations that are not the result of a service failure on our part.
These Terms are governed by the laws of the Republic of Peru. Any dispute arising from a booking with Peru Wayna Picchu will first be addressed through direct, good-faith negotiation between the parties; if unresolved, it will be submitted to the competent courts of Cusco, Peru, unless mandatory consumer-protection law in the Client's country of residence provides otherwise.
Payment of a deposit or any part of your program constitutes your full, informed, and binding acceptance of these Terms & Conditions, on behalf of every traveler named on the booking.
