Peru Wayna Picchu EIRL, registered under Tax Code 20601565243, is a Peruvian company specializing in the creation of exclusive and premium travel experiences. As local experts, we pride ourselves on designing tailor-made itineraries that combine luxury, authenticity, and meticulous attention to detail. Our mission is to connect you with the most iconic and hidden treasures of Peru while ensuring every aspect of your journey exceeds your expectations.

By choosing a program from Peru Wayna Picchu, whether through our website or a custom itinerary provided by your travel advisor, you (hereafter referred to as “the client”) implicitly agree to these Terms and Conditions (the “Terms”). These Terms govern the contractual relationship between the client and Peru Wayna Picchu EIRL, as well as the conditions of the services we provide.

 

Registration and Payment

To confirm your reservation with Peru Wayna Picchu, we require a deposit of 30% of the total program cost, with a minimum payment of USD 199. This deposit guarantees the availability of all services included in your itinerary, such as accommodations, transportation, cruises and activities. For flights, whether domestic or international, managed by us, payment must be made in full at the time of confirmation.

 

How to Confirm Your Reservation

Your reservation is considered confirmed upon receipt of the deposit. At this point, a binding contract between Peru Wayna Picchu and you (hereafter referred to as “the client”) is established. This ensures that all services included in your itinerary are secured and booked.

 

Accepted Payment Methods

We offer several convenient payment methods to make your booking process seamless:

  • Bank Transfers: Secure and direct payments to our official accounts.
  • Credit Cards: We accept Visa, MasterCard, and other major credit card providers.
  • Certified Checks or Money Orders: For clients who prefer traditional payment options.

Please note that any fees associated with international bank transfers or credit card processing are the responsibility of the client and will not be absorbed by Peru Wayna Picchu.

 

Final Payment Terms

The remaining balance of your program must be paid no later than 30 days prior to the departure date. For reservations made within 30 days of the start date, the total cost of the program must be paid in full at the time of confirmation.

Failure to complete payment within the specified timeframe may result in the cancellation of your reservation, with applicable penalties as outlined in our cancellation policies.

 

Currency and Pricing

All prices are quoted in United States Dollars (USD). If you choose to pay in another currency, the applicable exchange rate on the day of payment will be used. Any fluctuations in exchange rates or additional fees resulting from currency conversion are the responsibility of the client.

 

Tax Policies

  • Our program prices do not include Peru’s General Sales Tax (IGV) of 18%.
  • Peruvian citizens or residents requesting an invoice will have the 18% IGV added to the total price of the program.
  • Non-resident foreigners are exempt from this tax, provided they present the required documentation, including a valid passport and migration card (TAM).

 

Cancellations

All cancellation requests to Peru Wayna Picchu must be submitted in writing and are subject to the following conditions:

Non-Refundable Services

The following are non-refundable, regardless of the cancellation date:

  • Domestic and international flights.
  • Amazon cruises.
  • Certain train tickets.
  • Inca Trail bookings.

Administrative Fee

A non-refundable deposit of USD 199 will be retained to cover administrative costs.

Refundable Services

Cancellation fees for refundable services are as follows:

Cancellation Period Fee
20–30 days before departure 45% of refundable services.
12–19 days before departure 75% of refundable services.
11 days or less before departure 100% of refundable services.

Refunds, when applicable, will be processed within 30 business days, minus any applicable bank fees. No refunds will be provided for no-shows or partially unused services.

 

Postponement by the Client

We understand that plans can change, and Peru Wayna Picchu offers flexibility for postponing your trip under the following conditions:

General Postponement Policy

  1. Notice Period:
    • Clients who request to postpone their trip 20 days or more before the scheduled arrival date will receive a travel credit equivalent to the value of their original booking.
    • This credit is valid for future travel but will require a new quotation based on the rates and availability at the time of rebooking, which may differ from the original program.
  2. Exclusions:
    The following services are non-postponable and will follow the cancellation policy if rescheduled:

    • International and domestic flights.
    • Inca Trail permits.
    • Machu Picchu entry tickets.
  3. Amazon Cruises:
    • Postponement for Amazon cruises requires 30 days’ written notice before the scheduled departure to apply the value as a travel credit.
    • Requests made with less than 30 days’ notice will follow the standard cancellation policy.

Postponements made within 20 days of the arrival date (or less than 30 days for Amazon cruises) will also fall under the cancellation policy.

Any changes to new dates are subject to availability, and differences in pricing due to seasonality, inflation, or provider adjustments will apply.

 

Changes by Peru Wayna Picchu

Peru Wayna Picchu strives to deliver the services outlined in your confirmed itinerary. However, due to unforeseen circumstances, changes may occasionally be necessary. These changes are made with the intention of ensuring the safety, quality, and continuity of your program and are subject to the following conditions:

Minor Changes

  • Adjustments that do not significantly alter the overall experience of your trip, such as slight changes in activity timings, accommodation upgrades, or minor logistical adjustments, may be made without prior notification. These changes will not result in any refunds or compensation.

Major Changes

  • If a significant change is required—such as altering more than one-third of the program’s activities or changing the character of the itinerary entirely—we will notify you as soon as possible. In such cases, you will have the following options:
    1. Accept the proposed changes.
    2. Choose an alternative program of similar value, subject to availability.
    3. Cancel the program and receive a refund for the services not rendered.

Force Majeure

  • Circumstances beyond our control, such as natural disasters, political unrest, pandemics, or adverse weather conditions, may necessitate changes to the itinerary. In these cases:
    • We will make every effort to provide comparable services.
    • Refunds or compensation will not be issued for disruptions caused by events outside our control.

Exclusions

  • Peru Wayna Picchu is not responsible for changes imposed by external suppliers, such as airlines, cruise operators, or government restrictions, which may affect schedules or availability.

 

Promotional Photography

During your trip, Peru Wayna Picchu may capture photographs or videos of activities, landscapes, and group experiences for promotional purposes. By booking with us, you grant permission for your likeness to be used in such materials.

If you prefer not to appear in promotional content, please notify us in writing before the start of your trip.

 

Air Transportation

Peru Wayna Picchu may assist with booking domestic and international flights. However, flights are subject to airline policies, and the following terms apply:

  1. Pricing and Booking:
    • Flight quotes are subject to availability and are not guaranteed until full payment is made and tickets are issued. Deposits secure your booking but do not lock the fare.
    • Flight bookings are non-transferable and changes or cancellations may incur penalties as determined by the airline.
  2. Responsibilities:
    • Clients are responsible for verifying flight details upon receipt of tickets. Any discrepancies must be reported immediately.
    • Airlines are solely responsible for their operations; Peru Wayna Picchu is not liable for delays, cancellations, or rescheduling due to external factors such as weather, strikes, or mechanical issues.
  3. Liability:
    • International flights are subject to conventions limiting airline liability, as outlined in the ticket terms.

Peru Wayna Picchu will provide assistance in case of disruptions, but any additional costs, such as rebooking fees, are the client’s responsibility.

 

Cruise Transportation

In addition to the specific terms and conditions of the cruise operator, Peru Wayna Picchu is not responsible for operational errors or issues during the cruise. The traveler will receive detailed information about the cruise itinerary, including departure and arrival points, as part of their confirmed program.

It is the traveler’s responsibility to review all cruise-related details, including the correct start and end locations, and ensure alignment with their travel plans. Any discrepancies should be reported immediately to avoid disruptions.

 

Limits on Responsibility

Peru Wayna Picchu acts as an intermediary between clients and service providers, including hotels, airlines, train operators, cruise lines, and other travel-related services. While we carefully select trusted partners to ensure the highest quality of service, we cannot guarantee or be held responsible for their actions, omissions, or operational changes.

Scope of Responsibility

  1. Service Delivery:
    • Peru Wayna Picchu is not liable for any injury, loss, damage, or delay caused by third-party service providers, including but not limited to airlines, transportation operators, accommodations, and activity providers.
    • Any issues arising during the provision of these services must be addressed directly with the service provider.
  2. Unforeseen Events:
    • We are not responsible for disruptions caused by events outside our control, including but not limited to natural disasters, pandemics, political unrest, adverse weather, mechanical failures, strikes, or government actions.
  3. Client Responsibilities:
    • It is the client’s duty to comply with all laws, customs regulations, and requirements of the destinations visited. Failure to do so absolves Peru Wayna Picchu of any liability for resulting consequences, including denied access to destinations or services.
    • Clients are responsible for carrying valid passports, visas, and other required documentation for their travel.
  4. Operational Changes:
    • Changes to itineraries, schedules, or accommodations may occur due to factors beyond our control. These adjustments are made in the best interest of the client, and no refunds or compensation will be provided for changes that do not significantly alter the overall travel experience.

 

Limitation of Liability

The liability of Peru Wayna Picchu, if applicable, is strictly limited to the value of the services paid for and does not extend to cover indirect or consequential damages.

By booking with Peru Wayna Picchu, you agree to these limitations and understand the shared responsibilities involved in ensuring a smooth travel experience.

 

Illness or Disability

Clients with any medical condition, illness, or disability that may impact their participation in the program must inform Peru Wayna Picchu at the time of booking. Failure to disclose such information may result in exclusion from certain activities or the trip entirely, without entitlement to refunds. Clients are responsible for ensuring they carry any necessary medications or treatments during their travel.

 

Age, Fitness, and Participation

All clients must assess their physical fitness for the activities included in their itinerary. Certain excursions may require a moderate to high level of fitness. Participants under 18 must travel with a parent or guardian who assumes full responsibility for their participation. Peru Wayna Picchu reserves the right to deny participation in activities to individuals whose health or conduct may compromise the safety or enjoyment of the group.
